Official Rules

MUST BE AT LEAST EIGHTEEN YEARS OF AGE ON THE DATE OF ENTRY. 

Timing: The Competition (the “Competition”) is presented by Spry (the “Sponsor”) , and begins at 5:00 p.m. Mountain Standard Time (“MST”) on Wednesday, November 24th, 2021, and ends at 9:59 p.m. MST on Wednesday, January 5th, 2022 (the “Promotion Period”). Submissions will be accepted until December 15th, 2021 at 11:59 p.m. Sponsor’s computer is the official timekeeping device for this Competition.

Eligibility: To enter the Competition, the Participant (“you,” or “Participant”) must be at least eighteen years of age as of the date of entry. If you are under 18, your legal parent or guardian must upload the submission for you. Additional eligibility requirements are provided in these Official Rules. Officers, directors, employees, representatives and agents of the Sponsor, and any of their respective retailers, distributors, suppliers, and advertising and promotion agencies (collectively, the “Released Parties”), and the immediate family members (parent, spouse, child or sibling, and their respective spouses, regardless of where they reside) of such officers, directors, employees, representatives and agents, and those living in their same households, whether or not related, are not eligible to enter or win a prize. All applicable federal, state and local laws apply.

How To Enter: To enter the Competition a computer or smartphone device connected to the Internet is required. During the promotion period, you must visit the URL https://www.gigg.com/bestfails/ and follow the entry instructions to complete and submit the online entry form (the “Online Entry”).

Limit: One (1) entry per household will be allowed. Any individual or household member who attempts to enter, or in the sole discretion of Sponsor is suspected of entering more than once or submits entries in excess of the disclosed maximum, by any means, including but not limited to establishing multiple email accounts, will be disqualified from participation in this Competition. In the event of a dispute over the identity of the potential winner, the entry will be declared made by the authorized account holder of the email address submitted at the time of entry, and the potential winner may be required to provide identification sufficient to show that he/she is the authorized account holder of such email address.

Privacy: Collection and use of personally identifiable information and other records will be in accordance with the Sponsor’s Privacy Policy. 

Winner Notification: Potential Prize Winner(s) will be notified by phone and/or email. If the winner(s) cannot be notified for any reason beyond the control of Sponsor, his or her prize may be forfeited and awarded to an alternate winner. The potential Prize winner(s) is subject to eligibility verification and compliance with these Official Rules. The Administrator will attempt to notify the potential Prize Winner(s) via email within two (2) business days of the drawing using the email address provided at time of entry. In the email notice, the Administrator will provide all necessary documentation that the winner(s) must execute before being entitled to be the confirmed winner, and redeem their prize. The Prize winner(s) will be required to execute and return within ten (10) days of written notification an Affidavit of Eligibility.

Non-winning entries will not be notified. Acceptance of any prize constitutes permission for the Sponsor and its designees to use the winner's name and likeness for advertising and promotional purposes without additional compensation unless prohibited by law. Failure to complete and return the documents in the time noted or if prize notification is undeliverable will result in disqualification and an alternate winner may be selected and notified. Winning a prize is contingent on fulfilling all the requirements set forth herein. Winner is responsible for all federal, state, local and income taxes associated with winning prize. Prize Winner may be required to furnish his/her social security number for the sole purpose of preparation of any tax forms as required by law.

Prize Conditions:

Winner(s) must provide a name and email address where the following prizes will be shipped: Grand Prize Package of $3,000 cash and $1,000 gift card to APL, MyKayla's pick gets $2,000 cash, and top eight get to choose a pair of APL shoes. Prize (and/or any portion thereof) is non-transferable and non-exchangeable. No substitutions or cash redemption of Prize is permitted except that Sponsor retains the right to substitute a Prize of equal or greater retail value (or at Sponsor’s election, the cash value of the applicable prize). Additional restrictions may apply.

Conditions and Limitations: 

All entries become the property of the Company and/or Sponsor, who reserves the right to substitute a prize of equal or greater value. No substitution cash equivalent for any prize is offered, except at the sole discretion of the Sponsor. In no event shall more prizes be awarded than the number stated in the “Prize Conditions” section above. By entering, each Participant agrees to hold harmless and indemnify the Released Parties, which includes Spry against any and all liability, damages or causes of action (however named or described) due to any injuries, theft, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, receipt, possession, use or misuse of any prize or participation in any Competition-related activity or participation in this Competition, including any travel related thereto. All prizes are awarded “as is” with no at-law or implied warranties whatsoever. By participating in this promotion, participants agree to be bound by these Official Rules and the decisions of the Sponsor. The use of a script, macro, or automated or mechanical devices (or any other devices intended to automate or subvert any aspect of participation) to participate is prohibited and all such entries will be void. If Sponsor, in its sole discretion, determines that a Participant has used an automated, mechanical or similar device to participate or is in violation of these Official Rules, all entries from that Participant or email address or mobile phone number will be void. The Released Parties are not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with, or utilized in, this Competition or by any technical or human error that may occur in the processing and/or transmissions in the Competition. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of email due to technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to Participant’s or to any other person’s computer related Competition is not capable of running as planned, including, without limitation, infection by computer virus, bugs, worms, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the reasonable control of the Sponsor that may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Competition, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Internet portion of the Competition and select winners from all non-corrupted eligible entries received up to the time of termination.

CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS GAME IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND, SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

Disputes: Except where prohibited by law, all disputes concerning this promotion will be governed by and construed in accordance with the laws, rules and regulations of The United State of America, without regard to its choice of laws or conflict of laws provisions. Entrants consent to the jurisdiction and venue of the Federal or State or County courts for Utah.

The CTIA also prohibits the following types of message content. Adult content (e.g., pornography, nude dancing clubs, escort services), Illegal or illicit drugs (e.g., marijuana), alcohol, tobacco, firearms, gambling, violence, hatred, or profanity. Any product or service related to death (e.g., mortuaries and cemeteries). Any mention of any wireless carrier or any representation that copies or parodies any product or service of any wireless carrier.

 CHEATING

Using unethical practices to promote your video and increase the number of votes you receive may result in removal of invalid votes and other penalties up to and including disqualification from current and/or future competitions. Gigg reserves the right to remove people suspected of cheating, defined by this section, without explanation. Gigg holds no responsibility for any type of investment made by a participant that is disqualified due to cheating. Gigg takes extensive measures to prevent cheating, to ensure everyone has a fair chance. By uploading a video, you are agreeing to these terms and conditions. COMPETITION VOTING SYSTEM

Each Competition is made up of several voting phases (ie. Submission Period, Top 100, Top 25, etc (the number for each phase is prone to vary)). During the Submission Phase of a Gigg competition, participants will have the opportunity to submit their video entry. Once the Audition Phase is complete, participants may begin sharing and promoting their unique competition page link. Users then can immediately begin viewing and voting on submissions. Once the Audition Phase of a competition has ended, no more entries to the competition will be allowed.

Throughout each voting phase of a competition, a set number of entries will be passed through to the subsequent round either by highest Social Vote or by a Company Pick. See Competition Rules for more information.
